Where a complainant has made a series of false sexual complaints straddling the date of the alleged offending, the trial judge should assess the temporal and 'connected set of circumstances' requirements of s 293(4)(a) by reference to the pattern of complaints as a whole, not by considering each complaint separately. A series of false complaints may establish a predilection to make false complaints that bears on the objective likelihood of the alleged offence having been committed, extending beyond mere credit. However, N Adams J expressed doubt that such complaints satisfy the requirement that the events form part of the connected set of circumstances 'in which the alleged prescribed sexual offence was committed', leaving this question not fully resolved.
