Section 145(2) of the Body Corporate and Community Management (Standard Module) Regulation 2008 (Qld) does not impose a limitation period on proceedings to recover outstanding contributions. A body corporate that fails to commence proceedings within the two-year-and-two-month timeframe specified in s 145(2) is not barred from later commencing proceedings; the general six-year limitation period under s 10 of the Limitation of Actions Act 1974 (Qld) applies. However, the body corporate remains under a duty to commence proceedings within the specified time, enforceable by lot owners through the dispute resolution provisions of the Act.
