A mortgagee in possession of a lot in a Queensland community title scheme is liable under s 143(3) of the Accommodation Module Regulation for recovery costs incurred by the body corporate in recovering unpaid contributions from the lot owner, including costs incurred before the mortgagee entered into possession. Recovery costs fall within the definition of 'body corporate debt' as 'another amount associated with the ownership of a lot'. However, the mortgagee's liability is limited to costs 'reasonably incurred' under s 143(1)(c), and the reasonableness of the quantum remains subject to challenge.
