Acquittals on some sexual offence counts and convictions on others in the same trial are not necessarily inconsistent where the quality of the complainant's evidence of communicating non-consent differs between counts, because the jury may have been unable to exclude honest and reasonable but mistaken belief in consent on the acquitted counts but not on the convicted counts. The principles in R v LAK concerning warnings when replaying complainant evidence do not apply when the evidence replayed is from the accused's own police interview and includes all exculpatory material.
