Documents uploaded to a data room as part of a due diligence process can constitute written notice under s 421(2) of the Environmental Protection Act 1994 (Qld), provided they communicate the required facts and are accessed by the purchaser's representatives. The form of written notice under s 421 is immaterial provided it communicates that the land's particulars are recorded on the register and the details of any site management plan. Where a party nominates a related entity as purchaser, notice given to the original party's representative who becomes the nominee's director is attributable to the nominee as a matter of fact.
