A finding of dishonesty by a health practitioner, including dishonesty as a witness before the Tribunal, does not mandate suspension of registration where the Tribunal has found the practitioner unlikely to re-offend and has imposed conditions providing adequate public protection. The purpose of disciplinary sanctions under the Health Practitioner Regulation National Law is public protection, not punishment, and the ultimate issue on penalty is the risk of repetition of misconduct.
