Following the High Court's decision in DPP v Dalgliesh, sentencing courts must impose just sentences for incest offences correcting the error of principle in inadequate sentencing practices, without the restraint of gradual or incremental increases. Sentences of 6 years 6 months and 5 years 6 months for mid-range incest offences involving digital penetration of stepdaughters are within the range reasonably open. A non-parole period of 78% of the head sentence is not manifestly excessive where the offending is egregious and denunciation and deterrence are important considerations.
