A non-parole period of nearly three-quarters of the head sentence is not manifestly excessive where the offender has not engaged with any rehabilitative programs and has committed serial sexual offences against multiple victims while on bail and a community correction order. The decision in Russo v The Queen [2021] VSCA 244 is distinguishable where the offender in that case had taken significant steps toward rehabilitation including drug counselling and negative drug tests.
