A sentence of 14 months' imprisonment for a mid-range representative charge of indecent act with a child under 16 (maximum 10 years) is moderate and within range, particularly where the offender is sentenced as a serious sexual offender and the offending involves a breach of trust. Recent VSCA decisions such as Tones and Meharry reflect current sentencing practices more accurately than Sentencing Advisory Council Snapshots from earlier periods. Considerable cumulation is warranted where plea indictment offending involves a different victim, different time period, and different kind of sexual abuse from trial indictment offending.
