Whelan JA granted leave to appeal against sentence on the parity ground, finding it arguable that the applicant's sentence of 27 years (23-year non-parole period) for felony murder was unjustifiably disparate from the co-offender Cooper's sentence of 24 years (20-year non-parole period), given that Cooper was the one who stabbed the victim and had a prior conviction for aggravated burglary. The Court expressly did not resolve the merits of the parity argument.
