A sentencing judge who indicates a proposed sentence or indicates that co-offenders' roles are equivalent must alert counsel before departing from that indication; failure to do so constitutes a denial of procedural fairness. A prior sentence served interstate must be taken into account under the totality principle. However, established sentencing errors will not result in resentencing where there is no reasonable prospect of a less severe sentence being imposed, particularly where the original sentence was lenient.
