A sentencing judge's expression of a tentative view as to sentence, using language such as 'I'm thinking' or 'my initial feeling', does not constitute a denial of procedural fairness even where the ultimate sentence exceeds the indication, provided defence counsel had the opportunity to make full submissions and was not constrained by the indication.
