A court will refuse an extension of time to file an application for leave to appeal where the proposed appeal is so devoid of merit that it would be futile to grant the extension, even without determining whether the delay has been adequately explained. Alleged misconduct by a lender in relation to one loan facility does not collaterally nullify the lender's entitlement to enforce other independent loan facilities and their securities.
