A trial judge's discretion to discontinue a proceeding may miscarry if the judge overlooks the existence of a counterclaim on foot. The fact that a self-represented litigant cannot recover costs for their own time is not a reason for making no order as to costs at all — it goes only to the taxation of those costs, and disbursements may still be recoverable.
