Where the delay in seeking leave to appeal against sentence is lengthy, the applicant must adduce proper documentary evidence supporting the excuse for delay; bare assertions in solicitor affidavits unsupported by documentation are insufficient. Where psychiatric evidence includes qualifications that the offender is unlikely to relapse to prior severity and protective factors exist, a concession that the fifth and sixth Verdins principles do not apply may be appropriate and will not constitute error.
