Expert evidence of impaired mental functioning must establish a realistic connection or causal link to the specific offending in question; a general opinion that impairments were 'likely significant contributors' to offending behaviour, without relating that conclusion to the particular offending with specificity, is insufficient to engage the Verdins principles. Reports directed at different offending on a separate indictment, with heavily qualified and speculative conclusions, will not suffice to reopen the sentencing discretion on appeal.
