Sentences for aggravated home invasion under s 77B of the Crimes Act 1958 (Vic) may be assessed by reference to sentences for aggravated burglary under s 77 as a relevant touchstone. An offender who conceives and instigates a plan for armed home invasion and recruits others bears heavier culpability than co-offenders, which may justify equal or similar sentences notwithstanding differences in criminal history. The first co-offender to cooperate with authorities may receive a greater discount than subsequent cooperators, particularly where the cooperation was motivated by genuine concern about injustice.
