Where Commonwealth and State offences are sentenced on the same occasion and a global total effective sentence is fixed, pre-sentence detention should be deducted from the entire sentence at its end point, not set against the State segment alone. The question whether s 280(3) of the Criminal Procedure Act 2009 applies where three total effective sentences are imposed (State, Commonwealth, and global) remains unresolved. A sentence of two years' imprisonment for a single opportunistic sexual assault involving limited physical contact on a cognitively impaired victim, by an offender with no prior convictions who pleaded guilty, is manifestly excessive; the reasonable range is three to six months.
