In family and partnership disputes spanning many years with limited documentary evidence, courts will be very circumspect about granting summary judgment. Evidence of a family's practice of pooling income and working without individual wages may be sufficient to raise a triable issue as to whether properties registered in individual names were partnership property or acquired as part of a joint family endeavour. Where the question of when a partnership ended is itself in factual dispute, a limitation defence cannot be determined summarily.
