Advanced age is relevant to both limbs of the totality principle but whether and to what extent it mitigates depends on the particular facts and circumstances; where child sexual offending is sufficiently serious, advanced age may be given little or no mitigatory weight, and a sentence that may result in the offender dying in prison is not necessarily crushing. The 16-year gap between offending and charging was not regarded as a matter of significance.
