Where a sentencing judge indicates a discount under s 9AA of the Sentencing Act 1995 (WA), the head sentence to which the discount is applied cannot exceed the statutory maximum penalty, so the discounted sentence must be less than the maximum. A sentence of 18 months' imprisonment for non-commercial supply of 0.1g of methamphetamine shared with a friend, served cumulatively, is manifestly excessive where the offender pleaded guilty at the earliest opportunity, cooperated with police, and had no prior methamphetamine convictions.
