In a trilateral labour hire arrangement where the contractual terms clearly characterise the worker as a self-employed contractor and the indicia are reasonably evenly balanced, the parties' expressed intention will be given effect and the worker will not be found to be an employee of the labour hire company, notwithstanding that the worker did not operate a business of their own and was subject to the day-to-day direction and control of the host employer.
