In multi-party arrangements where a worker provides services to a third party's customers under the third party's brand and operational control, the significance of control as an indicator of employment with the intermediary entity is diminished. Where the competing indicia are reasonably evenly balanced, the parties' genuine understanding of their relationship as expressed in the contract and reflected in their conduct (including tax treatment) will usually be very instructive. The appellate standard for reviewing an evaluative determination of employment status is a full review, not a deferential one.
