The Court held that expert opinion evidence on matters of visual perception requires demonstration that the expert's specialised knowledge in that field derives from their training, study or experience — qualifications as a civil engineer or building consultant will not suffice without more. The case also confirms that the obviousness of a risk remains a significant factor in assessing whether a risk is 'not insignificant' under s 5B(1)(b).
