Form 1 offences cannot be taken into account when assessing the objective seriousness of a principal offence; they may only be taken into account by giving greater weight to personal deterrence and retribution. Where a sentencing judge takes into account aggravating factors under s 21A(2), the judge must indicate to which specific offence or offences each aggravating factor applies, rather than applying them globally. Motive to commit a crime is not necessarily inconsistent with acceptance of responsibility for the purposes of remorse under s 21A(3)(i).
