The gravity of injury caused is a pertinent but not determinative factor in assessing the objective seriousness of a s 33(1)(b) offence; factors such as planning, duration, brutality, and domestic violence context may sustain a mid-range or higher assessment even where injuries are towards the lower end of the grievous bodily harm scale. Sentencing statistics for aggregate sentences have limited utility where the composition of the other offences in the aggregate is unknown.
