Where a party provides an email address on an originating process under r 17(1)(a)(vi) UCPR (Qld), that party has given an email address 'under these rules' for the purposes of r 112(1)(e)(ii), and service of documents not requiring personal service may be effected by emailing to that address. Service takes effect at the time of emailing, regardless of whether the addressee has access to the relevant electronic equipment. The facultative provisions in s 39 of the Acts Interpretation Act 1954 and s 11 of the Electronic Transactions (Queensland) Act 2001 do not affect this position. Whether s 24 of the Electronic Transactions (Queensland) Act 2001 applies to service by email under the UCPR was left open.
