Trafficking in synthetic cannabis through a commercial retail operation, continued despite knowledge that the product was dangerous to consumers and had caused deaths, warrants a sentence above the range of four and a half to five years imprisonment identified in R v Verhagen for persistent illegal conduct motivated by greed. A head sentence of six years imprisonment with parole eligibility after 18 months was within the appropriate exercise of the sentencing discretion in such circumstances.
