When fixing the period of a supervision order under s 13A of the DPSOA, the correct question is when the prisoner will reach a point of acceptable risk without supervision. The court cannot set a shorter order on the assumption it will be extended under s 19B, but the existence of extension powers under ss 19B and 22 is not an irrelevant consideration when the evidence independently supports the chosen period as adequate. Psychiatrists should be asked to predict when risk will reduce to a low level, rather than simply recommending a duration.
