For the purposes of s 53(1)(b) of the Sentencing Act 2017 (SA), a continuous crime spree over several hours with no break in unlawful activity constitutes a single 'occasion' even where the offending involves different victims, locations, and types of offences. The four-fifths non-parole period rule in s 54(1)(b) applies to the whole sentence imposed on a serious repeat offender, not merely to sentences for qualifying offences. Section 52(3) describes an attribute of qualifying offences but does not limit the class of offences to which the consequences in s 54 attach. It remains open whether the four-fifths rule applies to all subsequent sentences or only sentences for serious offences.
