The 30-day appeal period under s 93(2)(c) of the Personal Safety Intervention Orders Act 2010 (Vic) is a strict mandatory time limit; there is no power in the County Court to extend time for filing an appeal, and s 98 of the Act does not incorporate the exceptional circumstances extension from s 109 of the Magistrates' Court Act 1989. A Magistrate is not obliged to stay intervention order proceedings on their own motion as an abuse of process to assist a self-represented litigant, as this would cross the boundary from judicial assistance into advocacy.
