A sentence of 3 years and 6 months' imprisonment for attempted aggravated burglary in a family violence context, involving an armed attempt to force entry to a residence at night to terrorise a domestic partner, is within the range reasonably available to a sentencing judge. A small cohort of comparable sentencing decisions (seven first instance decisions) is insufficient to establish a clear sentencing practice, and current sentencing practice is only one of many factors. The absence of an intention to physically harm, as distinct from an intention to assault by creating fear, does not much diminish the gravity of the offending where the purpose was to terrorise.
