A court of appeal will not interfere with a trial judge's credibility findings in a workplace bullying case where the applicant fails to demonstrate the findings are wrong by incontrovertible facts or contrary to compelling inferences. A trial judge's control of irrelevant and improper cross-examination by a self-represented litigant does not constitute a breach of the duty to afford a fair hearing. The duty to assist a self-represented litigant does not extend to advising on how to plead a case where the litigant has been warned of the deficiency by a prior judicial officer.
