'Substantially comply' in s 23(1B) of the Dangerous Sexual Offenders Act 2006 (WA) is a relative concept involving degrees of compliance, not a binary distinction between trivial and non-trivial breaches. The court must be satisfied the respondent will comply in a manner and to an extent consistent with the adequate protection of the community. Relevant factors include the respondent's history of compliance and non-compliance, attitude to conditions, capacity to comply, measures in place to ensure compliance, and the relative importance of any breach. The fact that a respondent is being dealt with for contraventions is not determinative of the issue.
