The Court declared the respondent a high risk serious offender under s 7(1) of the High Risk Serious Offenders Act 2020 (WA) based on his five-decade history of fire-setting offences, expert evidence of high reoffending risk linked to ruminative grievance-based thinking, and the inadequacy of NDIS supports and family accommodation alone to manage that risk. A three-year supervision order was imposed rather than a continuing detention order, on the basis that the respondent had substantially complied with his interim supervision order and that conditions including electronic monitoring, exclusion from bushland and Albany, and restrictions on possession of fire-starting implements could reduce the risk to a reasonably acceptable level. The Court removed curfew and associate-disclosure conditions as unsupported by the expert evidence on the facts.
