A sentencing judge is not required to express an assessment of objective gravity by reference to a position within a range, a formula, or a percentage; what is required is to fully identify the facts, matters and circumstances bearing on the gravity of each offence. The range of sentences imposed in past cases does not fix the boundaries within which future sentences must fall, and reliance on sentencing statistics and 'comparable cases' to establish manifest excess remains of limited utility.
