A sentencing court exercising Local Court jurisdiction may indicate a sentence at the two-year jurisdictional limit while also allowing a guilty plea discount under s 22(1) of the Sentencing Procedure Act; the notional pre-discount sentence need not fall within the jurisdictional limit. Indictable offences dealt with summarily under Chapter 5 of the Criminal Procedure Act remain 'indictable offences' for the purpose of constituting the CCA under s 5AF(3). The value of property stolen is only one factor in assessing objective seriousness and does not alone determine whether an indicated sentence is excessive.
