Where a sentence is accumulated upon a pre-existing sentence, the sentencing judge must consider the effect of accumulation on the effective ratio between the non-parole period and head sentence, and must address submissions regarding special circumstances. Failure to do so, resulting in an unintended effective ratio significantly exceeding 75%, constitutes House v The King error. If a sentencing judge proposes to impose a ratio greater than the statutory ratio, notice should be given to the offender as a matter of procedural fairness.
