Where co-offenders are charged with different offences reflecting different quantities of drugs supplied, different roles in the criminal enterprise, and have different criminal histories and subjective circumstances, significant disparity in sentences (including full-time custody versus an intensive correction order) does not give rise to a justifiable sense of grievance. Sentencing statistics are properly used as a yardstick but must not define the outer bounds of permissible discretion, and their utility is diminished by small sample sizes.
