A finding of special circumstances and the extent of any resulting adjustment to the statutory ratio between head sentence and non-parole period is a discretionary finding in respect of which the CCA will be slow to intervene. A modest 5% reduction does not of itself bespeak error. Matters of contrition and remorse have little, if any, bearing on a finding of special circumstances. A sentencing judge's assessment of rehabilitation prospects as 'guarded' is not inconsistent with a finding that the absence of reoffending over a long period 'enhanced' those prospects.
