An applicant who seeks to withdraw a guilty plea on the basis that they anticipated a lesser sentence than that imposed does not thereby impugn the integrity of the plea. An application for leave to appeal about sentence is not the occasion for revision or reformulation of the case presented below, including by resiling from agreed facts. Where an offender commits offences while on parole, backdating the sentence commencement to include the balance of parole period would offend the totality principle.
