Participation in a terrorist act with the object of murdering an innocent person, which object was achieved, falls within the high range of objective seriousness for offences under ss 11.2(1) and 101.1(1) of the Criminal Code (Cth). Youth as a mitigating factor is appropriately moderated in terrorist cases involving planning and carrying out acts of extreme violence. A total sentence of 38 years for multiple terrorist offences including one resulting in death is not manifestly excessive where the offender demonstrates no remorse and ongoing commitment to extremist ideology. Preparatory terrorist offence sentences (such as those in IM and Khalid) are of limited utility as comparators for completed terrorist acts causing death.
