In the Northern Territory, dead time (time served in custody on unrelated charges not resulting in conviction) is not of itself a relevant sentencing consideration for subsequent unrelated offending; only its effects on the offender's subjective circumstances (such as loss of employment, relationships, or particularly onerous conditions) may be taken into account as part of the instinctive synthesis.
