Where an applicant has been on bail pending appeal for a significant period with broken periods of pre- and post-sentence custody, the appropriate approach on re-sentence to an ICO is to commence the order on the date it is made and reduce the aggregate term to account for time served, rather than backdating the ICO commencement. A non-parole period must not be set for a sentence served by way of an ICO. Standard conditions and at least one additional condition must be imposed on every ICO at the time of sentence.
