Mixed verdicts across multiple counts of rape against the same complainant are not inconsistent where there are qualitative differences in the evidence on each count, such as differences in the strength of evidence of penetration or whether penetration was in issue at all. A Robinson direction is adequate where the trial judge directs the jury to consider the complainant's evidence with great care and summarises the specific problems in the evidence identified by defence counsel.
