A sentencing judge's error as to the maximum penalty for an offence, caused by incorrect information from counsel, reopens the sentencing discretion at least with respect to the sentence on that charge. Where a sentence represents 90% of the actual maximum penalty notwithstanding a plea of guilty, it fails to give adequate recognition to the plea. Cumulation on prohibited person in possession charges must account for overlap with substantive offences to avoid double punishment, but the status offence warrants distinct recognition.
