A sentence of 11 years' imprisonment with an 8-year non-parole period was upheld for manslaughter by criminal negligence where the offender failed to seek medical assistance for a seriously injured person over four to five days, the victim was vulnerable and dependent on the offender, and the offender had limited mitigating circumstances beyond a plea of guilty. Current sentencing practices, while relevant under s 5(2)(b) of the Sentencing Act 1991 (Vic), are only one of a number of factors in the sentencing discretion. Comparable sentencing decisions are not precedents.
