Where a consultancy services agreement provides for fixed monthly fees and defines the services as the provision of specified assistance 'to the extent requested', the payment obligation is not conditional on a request being made in any particular month; the 'Consultancy Services' encompass the ongoing commitment to provide assistance as and when requested. In statutory demand proceedings, where a contractual construction dispute has any element of rational controversy the court should exercise restraint and not determine the construction question, but where the applicant's construction is incapable of rational argument, the court may conclude there is no genuine dispute.
