The parity principle does not require formal identity of charges between co-offenders; it is concerned with substance over formality. Where co-offenders have broadly equivalent culpability on a common offence but one has distinctly more favourable personal circumstances (greater guilty plea discount, full admissions, youth, no prior record), a difference of one year in sentences on the common count does not infringe the parity principle. Where one co-offender also faces additional charges, the total effective sentence must be considered in the parity analysis.
