Parliamentary privilege under s 16(3) of the Parliamentary Privileges Act 1987 (Cth) prevails over the whistleblower protections in the Public Interest Disclosure Act 2013 (Cth), such that a public interest disclosure alleging that a response to a parliamentary question on notice was false or misleading cannot be relied upon to found a reprisal action where doing so would require the Court to draw inferences from proceedings in Parliament.
